AMDRAS IS COMING
The National Mediator Accreditation System (NMAS) has been replaced by the Australian Mediator and Dispute Resolution Accreditation Standards Board (AMDRAS).
In January 2008 the Mediator Standards Board (MSB) was established to provide a benchmark for the training and national accreditation of mediators in Australia and also to established standards of practice and conduct for mediators.
The NMAS set out the standards for the training, accreditation and practice of mediators who were accredited in accordance with the NMAS.
There has for some time been a view that there was a need to update and expand the nature and effect of the NMAS.
At a General Meeting of held on 5 June 2024 pursuant to a resolution of 22 March 2024 it was resolved by special resolution that:-
- the name of the MSB be changed to “Australian Mediator and Dispute Resolution Accreditation Standards Board Limited” with effective from 5 June 2024;
- the new constitution of the AMDRAS (see elsewhere under this tab) be adopted in full as the constitution of the new Company replacing the constitution of the MSB with effective from 5 June 2024;
At the meeting of 5 June 2024 the following “Authorisation” was carried by a simple majority:-
That any director or secretary of the Company be severally authorised to do all things necessary, ancillary, incidental, or desirable in connection with, or to give effect to, the documents, transactions, amendment, execution and delivery of any documents, certificates or notices and / or lodgement of any form or document required to be lodged with the Australian Securities and Investments Commission or any other government authority pursuant to the Corporations Act 2001 (Cth), or any other legislation.
The transition from the requirements for accreditation of mediators pursuant to the NMAS to the new AMDRAS will be complete with effect from 1 July 2025. The transitional rules the operate until 1 July 2025 are set out elsewhere under this tab.
